Such a dismissal terminates the suit in which it is entered, and is an adjudication upon the merits.' And, further, that `If a plaintiff in the second action has a cause of action against the defendant which he did not have in the first action, and which he could not have joined in the first action because he was not in privity with the defendant, then the judgment in the first action is not res judicata in the second action.'"
